Death penalty to three in 2012 gang rape, murder case

The three convicts, in December 2012 broke into the house of Shiva Koli at around 2 o’clock at night and looted the jewelry, cash and other items and gang-raped Shiva’s 30 years old wife who was sleeping with her minor son in the room, the special public prosecutor said.

Schedule Caste and Schedule Tribe (SC/ST) special court on Tuesday sentenced three youths to the death penalty for raping a 30-year-old woman and murdering her along with her minor son. The court also imposed a fine of Rs 75,000 on each of them under various sections of IPC, Arms Act and SC/ST Act. The three were booked in December 2012, in Udhyog Nagar police station of the city for charges of robbery, gang rape and murder.  

Special SC/ST court judge Girish Kumar Agrawal convicted Kapil alias Anna, Imran alias Dilliwala, both residents of Udhyog Nagar area of Kota city and Tipu alias Sultan alias Aabeed of Tonk district to death penalty under section 302/34 of IPC, told special public prosecutor (SPP), SC/ST court, Kota Kamal Kant Sharma. All the three convicts are about 25-27 years old, he added.  The court also sentenced the three to 10 years of imprisonment and imposed a fine of Rs. 20,000 over each of the three under section 376/2G and seven years of separate imprisonment under section 397 of IPC, the SPP said. The three were also convicted to life imprisonment and a fine of Rs. 20,000 under sections of SC/ST Act besides 10 years in jail and a fine of Rs. 20,000 under section 460 of IPC and three years imprisonment and fine of Rs. 5,000 under section 3 of SC/ST Act and fine of Rs. 10,000 under sections of Arms Act, SPP Sharma said.

The three convicts then shot down the woman and the son and fled away after placing the minor son’s dead body into a box, he added. Udhyognagar police on December 6, 2012, lodged a case in this connection under various sections of IPC, SC/ST Act and Arms Act and following the investigation arrested the three who are still in jail as they were not granted the bail. Total 35 witnesses were produced and 130 documents were submitted to the court during the trial, the SPP added.​
