Court RoundUp: Rajasthan High Court stays RERA orders

A real estate developers body and others have moved to the high court submitting that the authority has not established an appellate authority.

The Rajasthan High court has stayed orders issued by the state Real Estate Regulatory Authority and sought explanation over non constitution of a dedicated appellate authority in accordance to real estate regulatory act.  

A real estate developers body and others have moved to the high court submitting that the authority has not established an appellate authority. The act was implemented in Rajasthan in May, 2017 and dedicated appellate tribunals were to be appointed within a year period. However, the Food Safety Appellate Tribunal remains designated for the RERA appellate tribunal. The real estate developers body has objected on absence of the appellate authority, hearing on which the high court on Wednesday stayed action on all decisions of the regulatory authority. 

There is also difference in the presiding officer levels of the two appellate. The Next hearing in the case is scheduled on August 9. 

CJ to decide on bomb convict parole

A double bench of the Rajasthan High court forwarded parole application of a train bomb convict for consideration of the chief justice. The parole has been moved by Fazlur Rehman convicted in connection with the blast at Bombay Delhi Rajdhani Express near Kota in 1993. 

The blast at the train was part of serial terror strike to have shook the Indian railways on December 5 and 6, 25 years earlier. His parole application was objected against by the AAG on behalf of the central government on grounds that the convict has not moved parole request for approval of home department. 

The matter was thus forwarded for consideration of Rajasthan chief justice. Falzur was convicted along with 14 others for life imprisonment after over 2 decades of trial and hearing in the serial train blast. An appeal by him and others against the conviction was rejected by the supreme court.
