Jammu and Kashmir government today said West Pakistani refugees are citizens of the country but not permanent residents of the state.

In a written reply to the question of BJP member Jugal Kishore in the state assembly, revenue, relief and rehabilitation minister Raman Bhalla said "West Pakistani refugees are very much citizens of India and there is no separate citizenship for these refugees in the state".

The minister said a Constitution amendment is required to provide permanent residency to these refugees.

These PoK refugees, who chose to settle in rural areas, were rehabilitated by the way of allotment of state land and those who chose to settle in urban areas were allotted quarters and plots, he said.

They were subsequently conferred the land in respect to state lands and occupancy rights under section 3A of Agrarian Reforms Act, 1976.

Besides, government of India had initially allotted 6.17 crores for payment of ex-gratia relief at the rate of Rs5,000 per kanal subject to maximum of Rs25,000 per family in lieu of land deficiency.

The scale was subsequently enhanced to an amount at the rate of Rs30,000 per kanal subject to a maximum of Rs1.50 lakhs per family, he said adding an amount of Rs49crores has been sanctioined on this account, the disbursement of which is under process.
