Two brothers sentenced to life for killing neighbour

Two brothers were today awarded rigorous life imprisonment by a Delhi court for stabbing to death their neighbour following a verbal duel over a petty issue.

Two brothers were today awarded rigorous life imprisonment by a Delhi court for stabbing to death their neighbour following a verbal duel over a petty issue three years ago.

The court did not award the death penalty to the convicts saying "the crime did not warrant imposition of the extreme penalty. The settled legal position is that it should be awarded in the rarest of rare case."

Additional sessions judge SK Sarvaria also imposed a fine of Rs 5,000 each on convicts Sachin and Amit, residents of Dakshinpuri in south Delhi.

The court, however, acquitted Gopinath, father of the convicts, for want of evidence. The case against a co-accused, who is the younger brother of the convicts and a minor, was pending before a Juvenile Justice Board.

The convicts and the victim Naresh, who used to run their respective chicken shops at Dakshinpuri here, entered into a verbal duel on April 21, 2006 on the ownership of a wooden base, used for chopping the chicken.

After the altercation turned ugly Amit stabbed Naresh on the chest while his brother Sachin held the victim.

The court lent credence to the testimonies of eye witnesses Sanjay, brother of the deceased, and Rakesh as they supported the prosecution case, indicting the convicts.

Additional public prosecutor Davendra Kumar examined 19 witnesses to prove the case.
