Sohrabuddin case: CBI should arrest Geetha Johri, says Narendra Amin

In a major development, accused in Sohrabuddin Sheikh fake encounter case, suspended Dy SP Dr Narendra K Amin, asked the CBI court on Monday why the agency had not arrested IPS officer Geetha Johri despite adverse remarks against her by the Supreme Court. He told the Mirzapur court that the apex court had observed that Johri had diverted the investigation when she was probing the case as IG of CID (Crime).

Amin was pleading his case after the CBI moved the special court seeking his custody along with that of VA Rathod for further questioning in the case. Amin and Rathod had been arrested in the Sohrabuddin case.

Pleading his case in the court of additional chief metropolitan magistrate (CBI), VB Barot, Amin asked why Johri was given a clean chit and not arrested despite the SC observation. There is a nexus between criminal and politician in the case.

Raising loopholes on the part of CID (Crime) investigation, Johri had said that in 2007, based on Action Taken Report, the CID filed an application wanting the custody of ATS driver Nathuba Jadeja. Under section 70 of CrPC, an arrest warrant was issued against Jadeja.

Later Jadeja made a statement that he had seen Amin at the spot where Kausar Bi's body was buried. However, in the court, Jadeja retracted his statement. However, later Johri again filed an affidavit before the metropolitan magistrate with a plea stating that Jadeja is their witness and not accused in the case which was the final nail in Amin's coffin. Jadeja is an accused in the case as per the apex court's observation, while he is a witness for the Metropolitan magistrate.

Earlier, Amin in his application asked the CBI to clarify if the FIR registered against him in Sohrabuddin fake encounter case in 2007 by Gujarat police and the new FIR registered by CBI in February 2010 in Mumbai were for the same offence (fake encounter) or for separate and distinct cases. He has also asked the CBI to provide him with information about his arrest date under the FIR filed by the CBI earlier this year.

Amin also said that he was arrested on June 18, 2007 based on the petition of Rubabuddin Sheikh, and the day he was arrested he was given bail. However, from June 21 to 29, 2007 he was interrogated by CID as pre-remand four times. Amin added that since February 22, 2008 he is in judicial custody

According to Amin, it was his constitutional right to know the details of the case and requested the court to direct the CBI to provide the information so that he could prepare his case. Amin was DySP before being arrested in 2007.

Rathod, a police inspector, was allegedly involved in disposing of the body of Kausar Bi.

Magistrate Barot has scheduled May 19 for the order in the case.
