'It is clear that the CBI has been restricted after considerable amount of evidence was destroyed. However, it is also unfortunate that some of the evidence still available has not been acted on,' the mother said.

A day before returning to the UK after deposing in a Goa court, Fiona Mackeown today said she is in the process of gathering evidence in Scarlett's death case, which were not considered by investigating agencies in the chargesheet.

"It is clear that the CBI has been restricted after considerable amount of evidence was destroyed. However, it is also unfortunate that some of the evidence still available has not been acted on," Fiona, 46, said, this evening.

The British mother, down in India to depose in Scarlett death trial, said that she herself will be gathering some evidences in this case.

Fiona will be leaving for the UK on Friday as her cross examination in the Goa Children's court (GCC) ended this week.

"If even the CBI cannot be a deterrent to the criminals, then perhaps there is no hope," she commented.

Scarlett's battered body was found at Anjuna shore on February 18, 2008 following which two locals - Samson D'Souza and Placido Carvalho, were arrested by the Goa police.

The case was later handed over to the CBI.

Fiona said that there are few loose ends that need to be probed to get to the core of what exactly unfolded on the fateful night.

She said that an investigation to find out what happened between mid night to 3 am. (on intervening night of February 17-18) with Scarlett would unmask the faces involved in drugging her.

The British mother, who launched a campaign seeking justice for her beloved daughter, said the trial in GCC is moving at its own speed.

Fiona said she would like things to move faster, but certainly don't want to rush.

"A good trial would perhaps rope in all those involved in the death of my daughter," said Fiona.

Fiona said it is clear enough that Scarlett was provided with excessive narcotics, which resulted in her death.

"I do understand that it is not rare in Goa for young women to have their drink spiked, which is subsequently ends up in their rape or murder. I do hope that the Goa Police can effectively deal with people who indulge is such crimes," she commented.

Fiona said that Scarlett has clearly been a victim of the drug mafia operating in the coastal zone.

"This is less visible in the circumstances of her death but clearly visible in the subsequent cover up," she added.

The mother in her deposition before GCC had recalled how police sub Inspector Nerlon Albuquerque had initially goofed up the case before she insisted for a proper probe.
