Sajjan Kumar claims CBI witnesses in 1984 riots cases not reliable

Congress leader Sajjan Kumar today claimed before a Delhi court that the CBI witnesses, including a woman who lost her husband and nephews in the 1984 anti-Sikh riot cases, were not reliable as they had changed their versions a number of times.

"There are contradictions between different statements and affidavits given by witness Jagdish Kaur. She did not name Sajjan Kumar either in her first statement before police on November 3, 1984, or before justice Rangnath Mishra commission and Jain-Banerjee committee that inquired into the riots," Anil Kumar Sharma, advocate for Kumar, told the court.

Putting forth the arguments on framing of charges before additional sessions Judge Sunita Gupta, Sharma said it was only before the Nanavati cmmission in 2000 that Kaur named Kumar, as the man who had led the mob that attacked her house, for the first time after 16 years of the incident.

Reading out different affidavits submitted by Kaur, whose husband and three nephews were killed in the carnage in Delhi Cantt, Sharma submitted she had given different versions about the time of the incident.

During the two-hour arguments, advocate IU Khan read out a number of judgements of the apex court to say that CBI  committed an "illegality of investigation" as it did not take any permission from any court to take over the probe into the cases which were being inquired into by the Delhi police.

He contended that CBI can only further investigate the matter and not re-investigate by re-registering the riot cases as police had already filed cancellation report. Khan, who wanted to read out a portion of a book written by a police officer on the riots, was vehemently opposed by the CBI counsel, prompting the court to direct the defence advocate to avoid it.

The arguments in the matter remained inconclusive and are likely to continue tomorrow.

CBI had filed two chargesheets against Kumar and others on January 13 in the riots cases registered on the recommendation of justice GT Nanavati commission which had inquired into the sequence of events leading to the riots in the aftermath of
the assassination of the then prime minister Indira Gandhi.
