Protect UK girl’s dignity: HC

The chief justice of Gujarat high court has intervened in the matter of the British girl, Kaya Eldridge, who had to suffer much humiliation during the hearing of her case in a local magistrate’s court.

Chief justice KS Radhakrishnan has issued instructions to the metropolitan magistrate, through the chief metropolitan magistrate, directing him to ensure a dignified trial for Eldridge, using all the legal means at his disposal. The chief justice has also asked the magistrate to regularly submit a status report on all proceedings conducted in court.

The chief justice has further instructed the metropolitan magistrate to safeguard the legal rights of the girl. “There are many provisions in law for cases involving foreigners, especially women,” said PP Bhatt, registrar-general (RG) of the Gujarat high court. “The CJ has also instructed that a translator or an interpreter, who can help the British girl understand the proceedings in court, be provided.”

The law in such cases provides that the victim be explained the legal proceedings so that she understands them properly, and that she be given all legal documents in English translation. The law further provides that the victim be provided with an in-camera trial and the public prosecutor act in defence of the foreigner in court at all times.

“The metropolitan court on Friday sent a status report of Friday’s court proceedings,” Bhatt said. Earlier this week, the case had come up in the magistrate’s court for hearing after Eldrige lodged a complaint with the Satellite police accusing a local plumber of molesting her. After the hearing, Eldrige had complained to the chief justice about her humiliation in court.
