2G spectrum scam: Supreme Court wants CAG’s final report

Faced with varying figures in the 2G spectrum allocation scam, the Supreme Court (SC) sought to know on Monday whether there would be another report by the Comptroller and Auditor General (CAG).

According to the present CAG report, the scam has caused a loss of Rs1.76 lakh crore loss to the exchequer due to arbitrary decisions taken by former telecom minister A Raja.

To the question, “Is this the last report by CAG,” by a bench of justices GS Singhvi and AK Ganguly, department of telecommunication counsel, solicitor general Gopal Subramanium, informed the court, “perhaps that’s the last report”.

The court was hearing an appeal filed by the NGO, Centre for Public Interest Litigation (CPIL), seeking a probe by a special investing team under the guidance of the apex court.

Janata Party leader Subramanian Swamy, who had filed a special leave petition seeking court’s direction to the prime minister to sanction the prosecution of Raja, informed the court that after Raja’s resignation there might not be any need for seeking sanction to prosecute him.

He said he would file a criminal case before a Delhi court on Tuesday against Raja and others involved in the scam.

The court heard the arguments for about half an hour and fixed Tuesday for next hearing. In a courtroom packed to its capacity, Bhushan reiterated the allegations and expressed distrust in CBI. The government might contest the charge, but the investigating agency didn’t have a “good track record”, he said.

Media reports buttress this view, Bhushan said, referring to the disproportionate assets case against Mulayam Singh Yadav and Mayawati and the Bofors case.

Terming the 2G allocations the biggest scam of the country, Bhushan said CAG had also said that the ministry of communication & information technology, without any apparent logical or valid reasons, ignored the advice of ministries of law and finance.
