Patient wins battle against hospital, doctor after 12 years

A victim of medical negligence got his due 12 years after lodging a complaint at the Consumer Disputes Redressal Forum. The forum has asked the erring hospital and the accused doctor to pay for the complainant's treatment expenses and compensate him for mental harassment.

As per the complaint, Raju Makwana, a 22-year-old driver, suffered from acute stomachache and was taken to Thakarsi Charitable General Hospital on August 4, 1997. After a physical examination   by Dr Mehta, Makwana was diagnosed with appendicitis and Mehta advised him to have an operation. Following the recommendation, he was operated on the same day in the afternoon.

However, Makwana's condition further deteriorated and on August 10, owing to unbearable pain, he called for the doctor in the morning. But, he was attended to only late in the night. After physical examination, Mehta suggested that he was in pain due to  gastric issues and said that if the pain continues for two more days then Makwana would need to undergo another operation.

This led Makwana's family to suspect trickery and they got him transferred to Dr Ajay Patel's clinic on the same day by midnight.
Dr Patel, on physical examination, observed heightened stomach distension and found pus in the region of surgery, compelling an immediate operation. The operation, lasting three hours, resulted in as much as three litres of pus to be removed from Makwana's stomach.

Makwana sent notices to the hospital and doctor, asking for compensation but received no response. Following this, he filed a complaint on July 10, 1998 alleging that he suffered due to the hospital, doctor and the staff's negligence. However, the hospital authorities and doctor denied the allegation.

The forum held the hospital and the doctor guilty of medical negligence. The doctor and the hospital are to pay the expenses of the treatment, which amounts to Rs69,000, and Rs25,000 as compensation for mental agony.
