‘Only rioters booked’

Even as the Supreme Court-appointed Special Investigation Team (SIT) has nearly completed its probe in nine of the most infamous riots cases, a prominent NGO fighting for the cause of the victims has alleged that the agency has not explored the 'conspiracy theory' in three cases of Ahmedabad. The NGO has said the three cases are Naroda Patiya, Naroda Gam and Gulbarg Society.

"The SIT has arrested Maya Kodnani, Jaideep Patel, police officers KG Erda and VS Gohil in cases of Naroda and Gulbarg but it never looked at the conspiracy theory at all," said Mukul Sinha, convener of Jan Sangharsh Manch (JSM), here on Thursday. He said in the recently filed charge-sheets of Naroda Patiya and Naroda Gam cases, the SIT had only mentioned section 120B of IPC but not elaborated on any conspiracy.

Sinha's allegation comes a day after he met SIT chief RK Raghavan on Wednesday.Also on Wednesday,Naroda Patiya survivor Dildar Saiyad and JSM member Amrish Patel moved an application before SIT, seeking that the agency look for conspiracy theory in the three riot cases by doing further investigation under section 173(8) of CrPC, with respect to top police officers and the then home minister Gordhan Zadaphia.

Sinha alleged that the SIT had overlooked the possible role of the top police officers and politicians in the three cases. "This despite the fact that the SIT has had evidences like the CD of mobile calls prepared by IPS officer Rahul Sharma, which is a 'goldmine' for the agency."

He said that sloppy analysis by investigating officer in Naroda Patia case led to a large number of politicians, including Zadaphia, senior police officers, and some officials from the CMO escape arrest. In case of Gulbarg incident, Sinha said that an analysis of the phone calls showed how senior police officers had moved away from the society when mobs started gathering there.

"JCP of sector-2, MK Tandon, and DCP zone-4, PB Gondia, moved away from Gulbarg society giving a free hand to the rioters. It appears that a phone call from DCP zone-5, RJ Sawani, on the day prompted Tandon to move away from Gulbarg. Whether all these calls were made for the purpose of any illegal act or not, would be revealed only by deeper investigation by SIT," Sinha said.
