MCD to move SC over HC order on cycle rickshaw policy

In its ruling on February 10, the high court had said cycle rickshaws can ply in the national capital without any curb on their number as the fundamental right of rickshaw pullers to earn their livelihood cannot be violated.

The Municipal Coporation of Delhi (MCD today said it will knock the Supreme Court's doors against the Delhi high court ruling that lifted the restriction on number of cycle rickshaw pullers in the national capital.

"We had formulated the earlier rickshaw policy working under the guidelines of the Delhi high court while the recent decision has also come from the high court. We will move to Supreme Court so that we can get clear-cut guidelines on the issue," Delhi mayor Kanwar Sain said.

At the same time, Sain maintained that the MCD does not want to snatch the livelihood of rickshaw pullers. "We only want clear guidelines and policy." The issue was discussed at a meeting of MCD House today.

In its ruling on February 10, the high court had said cycle rickshaws can ply in the national capital without any curb on their number as the fundamental right of rickshaw pullers to earn their livelihood cannot be violated.

A full bench headed by chief justice AP Shah had quashed MCD's decision of not allowing more than 99,000 rickshaws to ply on the roads.

"The right of an individual or citizen to ply cycle rickshaw or other forms of transport falls within the legitimate exercise of his freedom guaranteed under the Fundamental Rights of the Constitution," said the bench, also comprising justice S Ravindra Bhatt and justice S Muralidhar.
