Despite the series of protests by lawyers and others against elevating Karnataka high court chief justice PD Dinakaran to the Supreme Court, there is little to stop that from happening.
Fali S Nariman, president of the Bar Association of India, and MN Krishnamani, president of the SC Bar Association, met chief justice of India (CJI) KG Balakrishnan to voice their concerns. But a delegation of senior lawyers who sought a meeting with him was turned away.
Krishnamani told DNA that the CJI said he would place the memorandum listing the details of omissions and commissions by justice Dinakaran before the collegium. But he also told Krishnamani and Nariman, “I don’t have any proof against him (justice Dinakaran).
The CJI has said with the collegium having already approved Dinakaran’s name, it is now for the government to take the next step.
But, highly placed sources in the law ministry say that since the collegium has approved the name, the government can’t alter it or scrap it.
BAI has “seriously’” appealed to the collegium “not to proceed further with his (Dinakaran) recommendation for the appointment to the apex court.
