Public prosecutor Naveen Kumar referred to medical records seized by the police at the time of his arrest and claimed that the accused was staying in the capital by identifying himself as Narsee Patel.
"As per the medical records recovered from his possession, Gandhy was getting himself treated at Sitaram Bhartiya hospital here as Narsee Patel," he told chief metropolitan magistrate Kaveri Baweja.
The court was hearing an application filed by Rajesh Tyagi, counsel for Gandhy, alleging that the accused, who was reportedly suffering from cardiac ailments and prostate cancer, was being denied basic medical facilities at the Tihar Jail, where he is currently lodged.
The court, which had on October one summoned a senior medical officer of the Jail with all his medical records, did not pass any direction after the jail doctor submitted that the accused was already referred to G B Pant Hospital, which is a super-speciality centre.
Gandhy was arrested on September 21 and has been sent to judicial custody till October six.
Meanwhile, police sources said the special cell, which is investigating the case, would soon approach the court for seeking his custodial interrogation. Gandhy, who is in charge of expanding the banned organisation's influence into urban areas, has reportedly been found suffering from prostate cancer and cardiac problems.
An alumni of the prestigious Doon School, Gandhy was in the top echelons of erstwhile CPI-ML (People's War group) from 1981 and then became a central committee member of the CPI (Maoist). He was elected to CPI (Maoist) politburo in 2007.
