Keep out of Ishrat case, SC tells Gujarat high court

Ahmedabad, Ahmedabad: Justice KS Jhaveri of the Gujarat high court on Monday adjourned the hearing in the Ishrat Jahan encounter case after the Supreme Court stayed all proceedings in the high court in the case. The high court adjourned the hearing till December 15. Earlier, the special investigation team set up on the instructions of the high court to probe the encounter case, submitted its progress report to the court in sealed cover.

The team, which comprises three IPS officers, also sought a three months' extension for the investigation.

The high court had asked the special probe team to conclude its investigation and submit its report before the court by November 30.

Meanwhile, in New Delhi, the Supreme Court bench of Justice B Sudershan Reddy and Justice Deepak Verma issued orders stopping all proceedings in the Gujarat high court in the case. The apex court stopped the high court from hearing the state government plea to annul the report submitted by magistrate SP Tamang in the case.

Ahmedabad metropolitan magistrate SP Tamang's report, submitted after a mandatory investigation under the CrPC, had indicted the Ahmedabad police for the 'staged killings'. The report said that the Mumbai college girl, Ishrat Jehan, and her three friends were shot in cold blood by the city police in June 2004.

While stopping the high court from conducting any judicial proceedings in the case, the apex court said it will itself hear the case on December 7. The supreme court bench took the action in response to a petition filed by Ishrat's mother, Shamima Kauser.
