Karnataka high court reserves order on Madani’s plea

The arrested People’s Democratic Party leader Abdul Nasser Madani had contacts with 12 other persons accused in the July 2008 serial blasts, special public prosecutor HS Chandramouli told the high court of Karnataka on Wednesday.

The high court reserved orders in a plea by Madani, requesting it to quash the chargesheet which had named him as an accused in the blasts.

Chandramouli opposed the plea saying the police had collected “substantial evidence” against Madani, arrested from Kerala’s Kollam district on Tuesday, after an eight-day effort.

In a 57-page statement submitted before justice Subhash B Adi, Chandramouli argued that Madani had maintained telephonic contacts with the 12 accused persons, before the blasts.

Chandramouli said statements of many witnesses had been recorded, which revealed a “nexus between Madani and the Bangalore blasts. Besides, we also have incriminating evidence in the form of independent material and phone records to show that he is one of the conspirators in the blasts”.

Madani used three phone numbers to contact the other accused persons. While two numbers belonged to his wife Soofiya Madani, the third belonged to Rajeeb.

During the investigation, police had recorded Soofiya’s statement and those of seven acquaintances of Madani, the court heard. “All the accused persons named in this case have been involved in the offences against the integrity, security, prosperity and unity of the nation and have actively maintained close association with banned Muslim outfits, Simi and Indian Mujahiddin,” police said.
Madani’s counsels Ravi B Naik and P Usman, however, argued that the PDP leader was being “framed” in the case and there was “no material to implicate” him.

“The fact that Tadiyantavide Nazeer, accused number one, had spoken to Madani was never brought out in the first chargesheet. The veracity of it has to be ascertained. Further the phone numbers furnished in the additional charge sheet do not belong to Madani and this was not there in the first chargesheet but created subsequently,” they said.
