Karnataka high court raps police, adjourns hearing of fiancé killer’s appeal to August 27

The city police incurred the wrath of the high court of Karnataka for not filing objections to appeals by a woman advocate and three others challenging a lower court order sentencing them to life in a murder case.

Taking note of the submission by the applicant’s counsel that the police have been failing to file objection for the past six weeks, a division bench comprising justices K Sridhara Rao and BV Pinto directed the police to file it on or before August 27.

“This is the last chance. No more excuses,” the court said.
Earlier, BV Nagesh, appearing for S Shubha, pointed out the police’s failure to the high court.

The special public prosecutor Venkat Rao requested the court for more time “since the state government is likely to file an appeal for enhancement of sentence.”

He said the prosecution was expecting a government order to file an appeal for an enhanced sentence. “Once we get the order, we will file the appeal,” he said.

Shubha and three other co-accused persons had moved the high court requesting it to quash the life sentence awarded to them by a fast track court. They were found guilty of conspiring to murder BV Girish, Shubha’s fiancé on December 3, 2003.

The fast track court had on July 14 awarded life imprisonment and slapped a fine of Rs50,000 each to all the four accused persons, Shubha, her lover Arun Verma, Venkatesh and Dinesh alias Dinakar, for criminal conspiracy under Section 120B of the IPC.
Venkatesh got one more life imprisonment, which would run concurrently, besides a fine of Rs50, 000 for murder.

Besides life imprisonment, the court had awarded Shubha an additional three year’s imprisonment and Rs25,000 penalty for destroying evidence and misleading investigators with false information to protect other offenders.

The fast track court had also ordered to pay Rs2 lakh to Girish’s  family.

Shubha conspired to eliminate Girish since she wanted to marry Verma.
