IT firm files data theft case against ex-employee

An IT company filed a case against a former employee, alleging he had stolen its software, data and passwords in collusion with his present employer, causing huge losses to it.

GURGAON: An IT company filed a case against a former employee, alleging he had stolen its software, data and passwords in collusion with his present employer, causing huge losses to it.
 
It was lodged by Acme Tele Power Limited against former employee Sachidanand Patnaik and two owners of Lambda Eastern Telecommunication, where he is working, Gurgaon Range Inspector-General of Police Mohinder Lal said on Sunday.
 
The matter "is very complicated and technical" and police would seek help from the National Association of Software and Service Companies, he said.
 
Acme senior manager (research and development) Pankaj Kumar Jain alleged in his FIR that Patnaik worked on 33 projects in the company and kept the secret passwords and data.
 
He stopped coming to office on April 2 this year and sent his resignation on April 16 after "corrupting and damaging" passwords and software codes, Jain alleged.
 
The company's investigations revealed Patnaik transferred details of two projects with software, code and passwords from his company e-mail ID to his personal e-mail on April 1, 2006, he claimed.
 
He alleged that on the basis of the stolen software, Lambda got orders of crores of rupees from a leading mobile operator whereas it had been developed by Acme, which spent a huge amount on R&D.
 
Lambda general manager Rakesh Prakash refuted the charges and said Acme was upset as his company had got the orders and "could not digest the rise of our company and its fall".
 
The IG said senior officials of both firms had met him on Sunday and apprised him of their stand.
 
He has directed Deputy Superintendent of Police Narinder Singh Ahlawat to conduct an inquiry into the matter.
 
The case has been filed under sections 379 (theft), 408 (breach of trust), 420 (cheating) and 109 (abetment) of the Indian Penal Code as well as some sections of the Information Technology Act, 2000.
