HC to hear Jadeja’s plea on August 18

A petition of Kandhal Jadeja, son of Godmother Santokben Jadeja, challenging an order of the Rajkot sessions court will be heard by the Gujarat high court on August 18.
Justice HN Devani of the high court has instructed the Rajkot court to hear Kandhal's pending application after August 18.

Kandhal has raised several issues pertaining to the legality of action of the Rajkot and Porbandar police after he was arrested from Pune on July 25 by a special team of the Porbandar police.

He has pointed out that the Porbandar police had illegally handed him over to the Rajkot police - without following any legal norm, including getting a transfer warrant. The Porbandar police, too,  had illegally detained him for more then 24 hours after bringing him from Pune.

The Rajkot police can't sought Revision application against denial of remand by the Metropolitan court various judgments of the high court.

According to case details, the Rajkot police had moved a revision application before the sessions court seeking police remand of Kandhal as the local metropolitan court had rejected their plea to that effect.

Kandhal, in his petition, claimed that the Rajkot police can't move a revision petition seeking police remand. He also moved four different applications raising several issues against the Porbandar and Rajkot police and expressed his apprehension that he may be killed in a fake encounter.

He also requested the court to hear all the four applications prior to hearing of the revision application. But the sessions court, on August 1, decided to hear all the four application along with the revision application. Kandhal has challenged this order of the sessions court in the high court, which will be heard on August 18.
