HC stays ADC Bank poll

In a major setback to Amit Shah-Ajay Patel faction, the Gujarat high court on Thursday stayed the election of the Ahmedabad District Cooperative (ADC) Bank, which was scheduled to be held on October 14.

Khokhara Mehemdavad Seva Sahakari Mandali and Dharmanagar Cooperative Housing Society had filed petitions in the high court against holding of the election, which were allowed by the court.

The election to elect 22 directors of the bank was to take place on October 14. The court has directed the bank to complete the process of delimitation within three months and start election process from November. Moreover, the court directed to scrutinise the 730 voters that were added in the voters list at the last moment. Apart from that, the change in sub section 8-1 has also been cancelled by the court. The bank has been given time till October 9 to move the supreme court against this order of the high court.

This verdict is a major blow to the BJP faction, as only one nomination was filed on 11 seats out of the total 22 seats. The Amit Shah-Ajay Patel faction had amended the constitution of the bank at the extraordinary meeting convened on March 14, 2009.

According to these amendments, only those members could contest for the post of a director who held a minimum 2,000 shares of the society of which they were a member, whose society had deposited Rs30,000 for three years with the bank and held ADC Bank's shares worth Rs5 lakh.

"According to these amendments, around 98% members would be rendered ineligible to contest. That's why we challenged the amendments in the court," said Narhari Amin, former deputy chief minister of Gujarat.

Arjun Modvadia, former leader of opposition, said that Amit Shah faction had joined hands with builders and financers to control the bank, he said.  Ajay Patel, chairman of the Ahmedabad District Cooperative Bank, said that they would  challenge the high court's order in the supreme court.
