Govt not telling the truth about CDs: Rahul Sharma

IPS officer Rahul Sharma has reiterated his stand that he had handed over the mobile call data CDs to the then chief of Ahmedabad crime branch PP Pandey.

In a rejoinder filed on Tuesday, the IPS officer told CAT that the state government’s reply to his petition challenging the departmental chargesheet issued to him, was full of ‘falsehood’ and ‘contradictions’.

Sharma, who has contended that he was being victimised for deposing before the Nanavati commission probing the 2002 riot cases, has denied all charges levelled by the state government in its reply to his petition filed before CAT on January 12.

In August 2011, the government had issued him a charge sheet for allegedly not returning the mobile call CDs he had prepared while attached to the team investigating the 2002 riot cases of Ahmedabad.

In his rejoinder filed through lawyers Mukul Sinha and KG Pillai, the IPS officer has claimed full immunity from all civil and criminal proceeding (except for perjury) under section 6 of the Commissions of Inquiry Act-1952.

Sharma has further alleged that the state government was not telling the truth when it stated that it had no knowledge of the existence of the CDs.

“The reply filed by respondent 1 (government) is full of falsehoods and contradictions, which in effect, end up supporting the contentions of the applicant (Sharma),”he has stated in his rejoinder.

He has pointed out that the government had admitted that it had no knowledge of the CDs and that it had first come to know about them only through his deposition before the commission.

“The deposition of the applicant (Sharma) cannot be used to give birth to any enquiry against him in view of Section 6 of the Commission of Enquiry Act,” the IPS officer has stated. The case has been posted for next hearing to February 21.
