Good development in Lotika Sarkar's property case: SC told

The Supreme Court was today informed that the Delhi Police has been entrusted with the investigations into dispossesion of an 87-year-old academician, Lotika Sarkar, of her property here allegedly by a senior IPS officer who has been held guilty by a tribunal of grabbing her house by deceit.

Solicitor general Gopal Subramanium told a Bench comprising chief justice KG Balakrishnan and Justices P Sathasivan and BS Chauhan that there have been good development in the case which is being probed by the crime branch and the tribunal to address grievances of senior citizens yesterday gave its findings against the officer.

He said since things have come on track, the police should be given an opportunity of a fortnight to place the report on the investigations into the case.

The central district tribunal, part of nine tribunals appointed by Delhi government to address grievances of senior citizens, also directed the deputy commissioner of police (south district) to immediately evict the IPS officer Nirmal Dhoundial and his family members from Sarkar's property at L1/10 in Hauz Khas Enclave. The tribunal declared a gift deed secured by the Dhoundials to grab the property as "null and void".

Lotika Sarkar, a former Delhi University professor of law faculty, had moved a petition in the apex court accusing Nirmal Dhoundial, an IG rank officer of Bihar cadre, of taking her property L1/10 Hauz Khas Enclave through a gift deed secured through deception in 2007.  

The apex court had earlier issued a notice to the police seeking a status report on the investigation of the case registered by Lotika Sarkar at the Hauz Khaus police station after it was alleged that the police were not taking any action on her complaint.

It was alleged the Delhi Police was not taking adequate steps for probing the case as Dhoundial, who is camping in the national capital, has been putting roadblocks in the investigations.
