Family creates a ruckus in Gujarat high court

Incident took place during hearing of a petition on kidnapping case.

The court of Justice Akil Kureshi of Gujarat high court saw some yelling as the family members and relatives of a Hindu girl, who had married a Muslim boy against her family's wishes, shouted and created a scene in the court room.

Justice Kureshi took strong objection to this and asked the girl's family to maintain decorum, failing which a contempt of court action would be initiated against them.

The incident occurred when burkha-clad Jhalpa Ankarj, 19,  reached the court along with her in-laws. On seeing the girl, Jhalpa's mother and relatives yelled at the court claiming that their daughter had been abducted by Mustafa Mallick.

Setting side the kidnapping charges and after quashing the petition, Justice Kureshi also ordered that police protection be provided to the girl. As per case details, Jhalpa, a resident of Morbi had a love affair with Patan-resident Mustafa. The boy was pursuing his BEd at Morbi. On July 6, 2009, the girl eloped with the boy and on July 13 they entered into a court marriage. The couple also sent the marriage details to the Morbi police and the girl's family.

On July 16, the girl's father Jashwant lodged a kidnapping complaint against Mustafa at Morbi police station.  Mustafa's advocate MM Sheikh later filed a petition to quash the arrest warrant and on August 11, Justice HN Devani stayed the investigation. "Later the girl's father lodged a petition with the Morbi court alleging that his daughter had been illegally confined by Mustafa and his relatives," said Sheikh.  Mustafa again filed a petition in the high court and also received a stay order on October 1.

Jhalpa's father again filed a habeas corpus in the high court but withdrew it later. Then he filed an application stating that the stay order granted by Justice Devani be vacated as the boy and relatives were threatening them.

On this application, Justice Kureshi had earlier ordered that the girl remain present on December 22. On Tuesday, the court after verifying the statements of both the parties quashed the complaint.
