Delhi High Court issues notice to 3 on anti-Sikh riot victim's plea

The appellant said the case was registered in 1992 following the recommendation of Jain Aggarwal committee, which probed the incident, after an affidavit filed by Bhatia in 1985.

The Delhi High Court today issued notice to the three persons, including a former deputy commandant CRPF and a police officer, on a plea by a 1984 anti-Sikh riot victim challenging their acquittal order last year.
   
Justice SL Bhayana also issued a notice to the police besides seeking a response from the accused persons Jagdish Singh, a deputy commandant in CRPF, Ishwar Singh, who now works in Customs department, and Rane, the then SHO of Paschim Vihar by April 19 on a petition filed by a 84-year-old man whose son Gurbakshish Singh was killed in the riot.

Filing an appeal through counsel HS Phoolka, the victim father Swaran Singh Bhatia told the court that the trial court was wrong in acquitting the accused on the ground that he (Bhatia) has named the accused persons before the police for the first time in 1993.

The appellant said the case was registered in 1992 following the recommendation of Jain Aggarwal committee, which probed the incident, after an affidavit filed by Bhatia in 1985.

Bhatia, who came from Canada to record his statement in 2008, said that on November One, 1984 a mob attacked his house in Paschim Vihar and killed his son and claimed to have seen that the three persons were leading the mob.

In the aftermath of assassination of the then prime minister Indira Gandhi by her Sikh body guards at her official residence on October 31, 1984, a major riot had broken out against the Sikhs in and outside Delhi.
