Court rejects anticipatory bail plea of Sajjan Kumar

Arguing for bail, Kumar's counsel IU Khan said the cases against the Congress leader were politically motivated and malicious in intent.

A Delhi court today rejected the anticipatory bail plea of Congress leader Sajjan Kumar in the cases relating to 1984 anti-Sikh riots after the prosecution contended that witnesses were apprehensive.

Special CBI judge PS Teji refused to grant any relief to the former MP who has been issued summons for his alleged role in the carnage that followed the assassination of the then prime minister Indira Gandhi.

The court also dismissed similar pleas of six co-accused in the cases.

It allowed the contention of CBI special prosecutor Y K Saxena who vehemently opposed the bail application on the ground that witnesses were apprehensive.

"Witnesses have been apprehensive. They have specifically stated the role of Sajjan Kumar in the riots, murder and arson," Saxena submitted during the arguments earlier in the day.

The CBI prosecutor also argued that the provision of anticipatory bail should not be invoked in grave offences like murder.

Arguing for bail, Kumar's counsel IU Khan said the cases against the Congress leader were politically motivated and malicious in intent.

Kumar had earlier been granted bail by the Delhi high court in 1990 in similar offences, he pointed out.

"He had also cooperated with the investigating agency during the probe. There was no allegation regarding any threat to the witnesses," Khan said.

Khan also referred to the long delay in registration of FIR in the matter.

During the argument, victims' counsel senior advocate H S Phoolka interjected by arguing that there was allegation of
mass murder against the accused and so he should not be
granted bail.

Peru, Mahender Yadav, Brahma Nand Gupta, Balwant Khokhar, Krishan Khokhar and Ved Prakash have been named as the
co-accused in the cases.

The accused are required to secure bail as they have been issued summons by a court on CBI's chargesheet against them. 

CBI had chargesheeted 13 people, including Kumar, on January 13 in two separate 1984 riots cases for allegedly making provocative speeches, leading to the killing of 12 persons in the violence that broke out following the assassination of the then Prime Minister Indira Gandhi.

The probe agency had filed the chargesheets in the court after concluding its investigation into the cases registered on the recommendation of Nanavati Commission in 2005.
