Court denies anticipatory bail in Ahmedabad land grabbing case

The sessions court, Ahmedabad rural, has rejected the anticipatory bail application of an accused booked in the case of an attempt of murder so as to deter criminals from grabbing land and using mafia tactics for deals related to land.

The sessions court, Ahmedabad rural, has rejected the anticipatory bail application of an accused booked in the case of an attempt of murder so as to deter criminals from grabbing land and using mafia tactics for deals related to land.

The case registered at Vastrapur police station states that Ashish Patel and others had attacked Chetan Patel over a dispute related to land documents. According to details, Ashish was engaged in the business of land deals. He had moved for bail application before the sessions court on December 23. Ashish had argued that he was innocent and had not committed any crime as has been alleged by the complainant.

The complainant objected the bail in his affidavit alleging that the accused was a notorious person having influential political contacts. Chetan had alleged that the accused was engaged in the business of threatening people to handover regional papers related to land grabbing. He said that Patel was involved in several land grabbing cases.

After examining the arguments of the case, the court rejected the bail and observed that as per the statement of the witnesses and other evidences produced by the police, it was a prima facie case against the accused. The accused is liable of the crime as others (his men) who were joint conspirators in the case were also associated to Ashish.

Rejecting the bail plea, the court observed, "The present case is related to the exchange of the documents related to a land. In this scenario, when prices of land are increasing in the city, crimes related to land are also on rise. In such circumstances, a person should rather fight the battle to get the rights in a legal manner. Instead the committed act of taking the law in hand cannot be tolerated."

The court further considered the argument put forward by the public prosecutor pointing out that it is the moral duty of the court to ensure that the mafia system should not enter into the land related disputes. Thereafter, the court rejected the bail application observing that in the current case, social security is of prime importance over individual independence.
