Charges framed against Erda in Gulberg society case

He has been charged with dereliction of duty and destroying evidence.

Charges were framed against Kiritsinh Erda in connection with Gulberg society massacre, which followed the Godhra carnage. Erda was the police inspector of Meghaninagar police station when the Gulberg society massacre took place.

Some 69 people were killed including former Congress member of Lok Sabha Ahesan Jafri on February 28, 2002 in the Gulberg society area in Chamanpura locality under Meghaninagar police station. 

The charges were framed in the court of session judge BU Joshi against the accused under criminal conspiracy, murder, attempt to murder, gangrape, inciting religious sentiments, robbery, loot and rioting. Prosecution lawyer, Naina Bhatt said, “Erda has been charged under section 120 (B), 302, 376 (2) (G), 201, 217, 218, 153 (A) of Indian Penal Code (IPC).”

Erda has also been charged for dereliction of duty as he failed to control the rioters and led them to create mayhem, all this while he was a public servant.

Moreover, he also allegedly helped the rioters in destroying the evidence.  Apart from this, Erda failed to collect blood samples and fabricated the panchnama.  Moreover, Erda also did not constitute a special team to investigate the rape cases.

However, Erda who was present in the court refused to accept the charges for which he has been booked.  Earlier, the court started its proceedings in the morning and documentary evidences were produced in the court.

Evidences of the witnesses will be taken on September 7. With, Erda being charged on Thursday the total number of people who have been charged has risen to 63, earlier, charges were earlier framed against 62 of the accused.

Moreover, last week Special Investigation Team (SIT) arrested Shivcharan Sharma in connection with the Gulberg society massacre, however, a charge-sheet is yet to be filed against Sharma in this connection.

Sources said that around 10 people have been declared absconders in the case.
