The Central Administrative Tribunal (CAT) has dismissed the plea of resident doctors of AIIMS seeking of scrapping the online test conducted by the premier institute for admission to super speciality courses of different medical colleges.

The tribunal refused to order fresh examination saying that the integrity of Controller of Examinations and Tata Consultancy Services (TCS), the firm which conducted the examinations, cannot be doubted.

"We are not convinced by the arguments that serious malpractices as alleged took place at the venue. We do not find any reason to doubt the integrity of the Controller of Examinations and the Tata Consultancy Services (TCS) in the light of the clarification given in the affidavit by AIIMS," the principal bench of CAT headed by Justice VK Bali said.

The tribunal also pointed out that AIIMS has already inquired into the matter and decided to conduct re-examination in few courses.

The petitioners, the Association of Resident Doctors of AIIMS and two doctors, alleged malpractices and use of unfair means in the examination for admission to Super Speciality courses in DM/MCh, held on May 15, 2011 at Manav Rachna University at Faridabad and sought a fresh examination for all courses.

The petitioners said due to problem in the server, the examination could begin at 10:30 am for some of the candidates and at 2 PM for others and there was no teacher present at the venue for supervision as a result of which total anarchy prevailed there.

"Total anarchy prevailed at the venue of the examination and mobile phones, internet connections, books, pen drives and laptops were used with impunity to find the correct answers to the questions," the petitioners had submitted to the court.

Sub-Dean (examinations) had a day later issued a circular for fresh examination for some disciplines saying that the server was damaged and on-line examination for cardiology, neurosurgery, paediatric surgery and urology could not be completed successfully.

The petitioner, however, argued AIIMS deliberately decided not to conduct fresh examination for the other subjects and urged that examination for all subjects should be held afresh.

In their response to petition, AIIMS furnished a list of faculty members who were present at the venue for supervision.
