CAG isn’t a munim, can examine govt policy: SC

Rebuffing a section of people who have been condemning the  Comptroller and Auditor General (CAG) since the national auditor pinpointed grave flaws in disbursing natural resources, including coal, the Supreme Court on Monday upheld the powers vested in the assessor observing its “not merely a munim (an accountant).’’

While rejecting a writ petition filed by Dr Arvind Gupta, a resident of NOIDA, contesting the CAG powers to conduct a probe rather than audit the accounts of states and Union of India, the court held that the CAG is a constitutional body. “If the CAG has exceeded his brief, it’s up to Parliament to debate and resolve the problem,’’, said a bench of Justices R M Lodha and A R Dave.

Rejecting Gupta’s plea that CAG isn’t empowered to review the government’s policy decisions, the bench said the national auditor is “entitled to review and conduct performance audit on revenue allocations relating to the Centre, the states and the Union territories.’’
