ATS charges imprisoned man with terror acts!

They said Pir Ali, serving a prison term, was involved in ferrying arms.

There is a twist in the case of Pir Ali —  a man who was charged of carrying out terrorist activities when he was locked up in jail and serving a sentence.

The curious case is being tried at the court of justice NV Parmar at Mirzapur Rural Court, while the accused, Pir Ali, is languishing in the Sabarmati central jail. The court on Tuesday examined statements of jail authorities in this connection.

According to Chandrashekhar Gupta, the defence lawyer, Abdul alias Pir Ali, a resident of Juhapura was arrested by the Vejalpur police in connection with rioting case on April 26, 2002 and booked under various sections of rioting and Arms Act. Ali was lodged at the Sabarmati central jail and on July 11, 2002 a charge-sheet was filed against him. He was later sent to Junagadh district jail as a Pasa convict in May 3, 2002. However, after almost five months, Ali was released on bail on October 16, 2002.

Therefore the defence lawyer pointed out to the fact that Ali was lodged in the Sabarmati jail and Junagadh district jail in the period between April 26 and October 16, 2002. 

Interestingly, however, the  ATS booked Pir Ali for terrorist activities in session case number 71/06. According to the charges, Ali had gone to Hyderabad in August 2002 for delivering arms and ammunitions. It booked six people for delivering arms and ammunitions to a person in Hyderabad.

In his argument defence lawyer Gupta further said that they have also recovered the name slate of Pir Ali, which was taken by the Vejalpur police while he was being arrested in April 2002 and also the entry register of undertrials in both Sabarmati central jail as well as Junagadh district jail.

According to the ATS case details, one of the six people arrested in connection with delivering of arms, Zahid Khan had given Pir Ali two railway tickets and Rs3,000 along with a bag containing four packets to be delivered to this contact in Hyderabad. Later,  Zahid Khan revealed to one Anwar Ali that the packets which Pir Ali was carrying for delivery contained four pistol and 50 cartridges.
