Ashram deaths: 7 sadhaks’ anticipatory bail plea rejected

The session court of judge, DT Soni rejected the anticipatory bail plea moved by seven sadhaks of Asaram ashram in Dipesh and Abhishek Vaghela case. The court observed that based on the investigation it appears that prima facie there is a case of involvement of the sadhaks and the custody of the sadhaks is needed.

The sadhaks— Pankaj Saxena, Yogesh Bhati, Vikas Khemka, Min Ketan Patra, Uday Sanghani, Kaushik Vaani and Ajay Shah were charged with negligence that led to the death of two boys, Dipesh and Abhishek Vaghela.The two boys went missing on the night of July 3, 2008 and their mutilated bodies were found near the Sabarmati riverbed on July 5.

It also directed the public prosecutor, Sudhir Brahmbhatt to bring to the notice of the commissioner of police the attitude of PSI Pandya of Chandkheda police station.
Pandya had apparently shown lackadaisical approach in registering a complaint.Seeking bail for the sadhaks, defence counsel BM Gupta pleaded that CID crime had booked them under section 304 of IPC, which amounts to death due to negligence with knowledge and intention.

However, in this case there was no element of intention and knowledge on the deaths of the two boys.Stating that granting bail to the sadhaks will give a wrong impression to the society, prosecution lawyer Sudhir Brahmbhatt said that the sadhaks, who were absconding even after an FIR was filed against them, should undergo custodial interrogation.
