1984 riots case to be heard by CBI judge

The law seems to be finally catching up with veteran Congress leader Sajjan Kumar, tainted in the 1984 anti-Sikh riots case. A former Congress MP Kumar will now face trial in the riot cases pending against him in a special CBI court from March 27.
Taking strong objection to Kumar's sustained efforts of delaying trial in the cases, additional chief metropolitan magistrate Lokesh Kumar Sharma, on Saturday, declined the leader's application seeking documents related to the chargesheet filed against him in the two cases.

The cases have been transferred to the sessions court, as the ACMM doesn't have power to hear murder cases.

Directing Kumar and his co-accused to appear before the special CBI judge on March 27, the ACMM said, "I am not impressed with the arguments and contentions of the accused. The application has been filed to cause further hindrance in committing the case to the Sessions court. Under the garb of application the accused is trying to set up his defence by placing his documents and records."

During the arguments, senior advocate IU Khan, appearing for the former MP had submitted that the CBI had failed to supply documents necessary for a fair decision of the court.

However, brushing aside Khan's contention the ACMM said, "I have gone through the contents of the application and perused the documents. The bunch is so bulky, it is humanly impossible to examine the same within a short span of time."

The court's decision comes as a setback for Kumar who had a moment of triumph in the court proceedings on March 10 when the
ACMM had granted him bail in the case following the Delhi High Court's grant of an anticipatory bail to the leader citing delay in deposition of witnesses.

The Congress leader along with Girdhari Lal, Balwan Khokhar, Mahender Yadav, Maha Singh, Capt Bhagmal, Santosh Rani and Krishna Khokhar was been named as an accused in the murder of five persons in Delhi Cantonment area during the 1984 riots.
