Ahmedabad doctor, hospital blamed for illegal MTP death

The State Consumer Commission came down heavily on a doctor for 'illegally' performing MTP (medical termination of pregnancy) on a woman, and the LG hospital for medical negligence, blaming both for the woman's death. The commission has asked the Ahmedabad Municipal Corporation and the Gujarat Medical Council to conduct an enquiry and take action against the doctor and the hospital.

The commission was hearing the appeal filed by Dr Chetan Shah challenging the order of the consumer forum. Shah had allegedly performed an MTP operation for which he was not registered. After the surgery, the woman developed uterine and intestinal perforation because of which she died.

As per the case, Bina Dogra and her husband had three children. Hence the couple had sought MTP for Bina in 2002. As Shah's clinic was at walking distance from their residence, the couple had approached the doctor.

The operation was performed but due to alleged negligence on the part of Shah, Bina developed post-operative complications. Shah advised them to shift to LG hospital and gave them a cheque for Rs30,000 towards payment of costs. Bina was again operated on at LG hospital but there was no relief in her symptoms. She was then taken to a private hospital where she died.

Her husband, Prakash Dogra, filed a case at the consumer forum against the doctor and LG hospital. The forum asked the doctor to pay compensation to the Dogra family but Shah challenged the order before the State Consumer Commission.

Dismissing Shah's appeal, the Commission held that the doctor's conduct had been unprofessional and inhuman. He was not qualified to perform MTP nor was his hospital an approved centre for the procedure, the commission said. Yet, he had performed the surgery, causing her much suffering and ultimately death.

The commission held LG hospital equally guilty and observed that the hospital had failed to record Shah's name in the history of the patient while admitting Bina. It appeared to be in collusion with the doctor, the commission observed. The commission then forwarded a copy of the order to the Gujarat Medical Council and also to the commissioner of Ahmedabad Municipal Corporation for necessary enquiry and action.
