The CBI on Friday assured the Supreme Court that it wouldn’t arrest Nupur Talwar —  accused of murdering her 14-year old daughter Aarushi — until the court takes a decision on her petition against an HC order directing her to surrender before the trial court.

She faces a non-bailable warrant issued by a Ghaziabad court. She has filed a petition seeking to scrap an Allahabad high court order asking her to surrender before the trial court which would deal with her plea for bail.

Refraining from making any direct comments on the live telecast on efforts being made by the CBI to arrest Nupur, the judges observed, “She needs protection”.

Taking a cue from the court’s remark, additional solicitor general Haren Raval assured that she wouldn’t be arrested until a decision is taken by the top court. “Have faith in us,” Raval said.  “We have faith in you (CBI),” judges replied.

Following the April 9 high court order, the Ghaziabad court had listed the Aarushi murder case on April 11 and Nupur’s presence had been sought by it. However, she failed to appear for the trial and the court directed the CBI to execute the non-bailable warrant while fixing April 18 for the hearing.

During the hearing, Raval revealed that the agency was aware of Nupur’s movements.

In her petition, Nupur pleaded the top court that that besides being an “aggrieved mother and law abiding citizen”, she also “enjoys the reputation as one of the best dental surgeons of this country”.
