2G spectrum scandal: Judges ‘managed’, says anonymous letter

An anonymous letter to the judges hearing the 2G spectrum issue has alleged that they have been “managed” in the Rs1.76 lakh crore scam case. The letter was received by justice AK Ganguly at his residence. Both the judges, however, have rubbished the letter.

Justice GS Singhvi, who heads the two-member bench hearing the case, disclosed about it on Wednesday. “That anonymous letter is part of the office record now. The allegations are that we have been managed,’’ the bench said.

The court allowed the lawyers engaged in the law suit filed by the Centre for Public Interest Litigation (CPIL) and former chief election commissioner JM Lyngdoh to examine the letter. A lawyer who had access to the letter told DNA that the letter is addressed to the chief justice of India (CJI).

“It alleges that the judges hearing the scam case have been managed and urges the CJI to ensure justice,’’ he said.

In an unanimous reaction to the judges’ disclosure, all the lawyers – the counsel for the department of telecom (DoT) and solicitor general Gopal Subramanium, CBI’s lawyer KK Venugopal and former DoT minister A Raja’s counsel TR Andhyarujina — urged the bench to “throw the letter into the basket”. Justice Ganguly said he had already done it.

The bench has reserved its judgment on Janata Party leader Subramanian Swamy’s petition concerning the timeframe within which the authority concerned must respond to a letter seeking sanction to prosecute a public servant.

Attorney general Goolam E Vahanvati, counsel for the PMO, asked for a week’s time to file a list of cases in which sanction for prosecution of public servants is awaited.

During the hearing, judges hinted at monitoring the investigation in the 2G scam by a special investigating team. While DoT’s lawyer Subramanium had no objection, CBI’s lawyer Venugopal opposed it saying the investigating agency was already working on the gigantic case.
