The 2G special CBI court on Monday directed the CBI to submit a law ministry report which stated that a firm should have more than 10% stake in another company to be termed as an associate. This is the plea taken by the Swan Telecom that it was not an associate of Reliance Telecom Ltd (RTL) and could benefit from this order.

“It is ordered that CBI would place a copy of the report received by it from Ministry of Law and Justice through Department of Telecommunication on record on the next date,” special CBI judge OP Saini said, slating September 21 for arguments. RTL and Swan Telecom, an alleged beneficiary of the scam, have been taking the defence that they were not “associate” firms as RTL’s stake in STPL was below 10%, as mandated under the guidelines for the Unified Access Service (UAS) Licenses.
