22G case: Essar and Loop promoters likely to appear in court tomorrow

Promoters of Essar Group and Loop Telecom are likely to appear tomorrow in a Delhi court in connection with the summonses issued to them in a case arising out of the probe in the 2G spectrum scam.

Fresh summonses were issued by Special CBI Judge OP Saini, who is trying the 2G case on a day-to-day basis, against Essar Group promoters Anshuman and Ravi Ruia and Loop Telecom promoters I P Khaitan and Kiran Khaitan after they did not appear before it in pursuance to its earlier order.

They had not appeared in the court on January 27 claiming the summonses were not "duly" served on them.

The order came after special public prosecutor U U Lalit had said no personal service of summons could be effected on these four accused and addresses, for which the processes were issued, were given by them during the investigation.

Besides Ruias and Khaitans, CBI had named Vikash Saraf, Essar Group Director (Strategy and Planning) and three firms Loop Telecom Pvt Ltd, Loop Mobile India Ltd and Essar Tele Holdings as accused in the case.

The apex court had on February 15 refused to grant interim stay on the summonses issued to them but agreed to decide their plea challenging the jurisdiction of the Special CBI court in hearing their case in the absence of corruption charge levelled against them.

Essar, which has denied any involvement in the 2G case, contended the special court cannot proceed against them as they were not charged under the Prevention of Corruption Act.

The telecom firms had said they have been chargesheeted under section 420 (cheating) and 120B (criminal conspiracy) of the IPC and the charges were triable by a magistrate and not by the special court constituted under the Prevention of Corruption Act for hearing the 2G case.
