2008 Delhi blasts: Proper sanction obtained to prosecute accused

A Delhi court trying the 2008 serial blasts in the capital, allegedly involving terrorists of Indian Mujahideen (IM), was today told that there was proper sanction for prosecution of 13 accused under the anti-terror law.

A Delhi court trying the 2008 serial blasts in the capital, allegedly involving terrorists of Indian Mujahideen (IM), was today told that there was proper sanction for prosecution of 13 accused under the anti-terror law.

"The matter was processed through proper channel and was put before competent authority, office of Lt Governor of NCT of Delhi," Ashish Kumar, SDM, Civil Lines, who was then posted as Deputy Secretary (Home-II), NCT, told Additional Sesssions Judge Narinder Kumar.

The SDM, who was testifying as a prosecution witness in the case, said that on December 1, 2008, he had received records from Delhi Police for obtaining sanction for accused Mohd Saif, Zeeshan Ahmad, Zia-ur-Rehman, Saquib Nisar and Mohd Shakeel under section 195 CrPC and Section 45 of Unlawful Activities (Prevention) Act.

He said the matter was put through proper channels before the office of Lieutenant Governor and after receiving file from the Secretariat of Lieutenant Governor having approval of competent authority, he issued sanction order dated December 15, 2008 and forwarded it to the Police Commissioner, DCP (Special Cell) and DCP (Headquarters).

Kumar also said another similar sanction by a February 26, 2009 order was forwarded to the police for accused Kayamuddin Kapadia, Mohammed Sadique and Mohammed Hakim.

Besides these, other accused in the case were Mohammed Mansoor Ashgar Peerbhoy, Mubin Kadar Sheikh, Asif Bashiruddin, Mohammed Akbar Ismail Chaudhary and Shahzad Ahmed.

Kumar's further examination was, however, deferred after the Public Prosecutor told the court that he has not brought complete records.

"Further examination deferred on request of Additional Public Prosecutor that the concerned clerk for Home Police II has not brought complete records," the court said.

Another prosecution witness to be examined today was A Dey, Principal Scientific Officer of CBI's Central Forensic Science Laboratory. He too could not be further examined for not bringing certain original records.

The trial of the case is being conducted via video-conferencing as 11 of the 13 accused are lodged in Sabarmati jail in Gujarat while two are lodged in Tihar Jail.

All the accused are facing trial under various sections of Indian Penal Code including those concerning waging war against the government of India, criminal conspiracy and murder and under various provisions of the Explosive Substances Act and the Unlawful Activities (Prevention) Act.

A series of blasts had rocked the national capital on September 13, 2008, killing 26 people and injuring 135 others.
