Yogi Adityanath gets reprieve from Allahabad HC in 2007 Gorakhpur riot case

However, his troubles may be far from over.

Uttar Pradesh Chief Minister Yogi Adityanath got a major reprieve from the Allahabad High Court on Thursday when it dismissed the revision petition seeking to file a criminal case against him in connection with Gorakhpur riots in 2007.

Passing an order on the revision petition filed by Rashid Khan, Justice BK Narayana, however, directed the CJM Gorakhpur to the decide the matter afresh while dismissing the revision petition. The verdict was earlier reserved by the High Court on December 22, 2017.

“In view of the foregoing discussions, no interference with the impugned order is warranted. This application lacks merit and is accordingly dismissed,” said Justice Narayana in his order.

“However, by way of abundant caution, CJM Gorakhpur is directed to decide the matter afresh pursuant to the impugned order of remand strictly in accordance of law and in the exercise of his unfettered discretion, without being influenced by observations, if any, made by the revision court in the impugned order,” further said Justice Narayana.

Legal experts however feel that even after the dismissal of the revision petition, troubles for Chief Minister are far from over as the Allahabad High Court has directed the CJM Gorakhpur to decide the 2007 Gorakhpur riot case afresh. Yogi Adityanath was an accused in the chargesheet filed by the police and the ACJM court had taken cognizance of it to file a case against then BJP MP from Gorakhpur.

Later, the ACJM Court order was, however, dismissed by the Additional Sessions Court on the ground that there was no proper permission from the  state government to run the case against Yogi Adityanath and others. Following this,  Rashid Khan had filed a revision petition in the Allahabad High Court which was dismissed on Thursday.
