Wife tries to kill him, but man wants her free

Love conquers all! The phrase fits perfect on this Andheri-based couple: the wife attempts to murder the man by stabbing him on his neck, but he tells the Bombay High Court that he is not against the quashing and setting aside of the case and the release of his imprisoned wife. The court granted him his wish.

A division bench of Justices RM Sawant and Sandeep Shinde, while directing the release of the woman from the Byculla prison, said, "We are of the view that continuing the prosecution of the petitioner (the woman) would perpetuate the difficulties and agonies of the couple, as prosecution would have a debilitating effect on the lives of both. We are therefore of the view that the interest of justice would be served if the request is acceded to."

Appearing for the woman, advocate Mujahid Mulla argued, "The couple got married in 2002. Unable to come to terms with her infertility, the woman developed psychiatric problems and was called to Mumbai for treatment. Though the couple quarelled often, they were still affectionate towards each other. Hence, considering this as a one-off incident, she the case against her should be quashed and set aside."

The husband, a taxi driver, is still recovering and is being fed liquid diet through a pipe. He filed a consent affidavit stating: "During the 15 years of our married life, this was the first violent incident between us. If she is released, I will be able to take care of her and ensure she gets proper psychiatric treatment."

It was on September 7 last year, around midnight, when the complainant in the case, a neighbour of the couple, saw the man running out of his house screaming for help, saying his wife stabbed him. The neighbor rushed him to Rajawadi hospital and also lodged a police complaint.

The police arrested the wife under attempt to murder charges (section 307 of IPC). She is currently in judicial custody.

The husband in his consent affidavit said, "I will not hold any grudge against her and will cooperate with the petitioner (the wife) and will take care of her." Accordingly, the court quashed and set aside the criminal case.
