A division bench of Calcutta HC on Monday sent back the plea over conducting Panchayat polls in West Bengal to single bench of the High Court, reports Zee 24 Ghanta. A division bench of justices Biswanath Sommader and Arindam Mukhopadhyay heard the matter on a plea by the TMC and Election Commission. Earlier a single bench of the HC extended stay on conducting Panchayat elections in the state.

The division bench said that the litigation should be swiftly resolved and if necessary the HC will go for daily hearing. The opposition had went to HC asking for a stay in Panchayat election procedure alleging widespread violence by the ruling party. A single bench gave an interim stay and TMC and EC went to the division bench challenging the decision.

During plea, justices asked lawyer from TMC, MP Kalyan Banerjee that why they have appealed to the division bench when the single bench is hearing the matter. They also said it is wrong to presume the decision of the single bench and asked TMC to go back to Justice Subrata Talukdar's court. Kalyan Banerjee later said that they will raise the matter tomorrow /

A single bench of the Calcutta High Court today extended a stay on the panchayat election process in West Bengal till the next date of hearing as an appeal on the maintainability of a petition by the BJP is pending before a division bench.

The State Election Commission and the Trinamool Congress had moved the division bench comprising justices D Somadder and A Mukherjee challenging the single bench order which had accepted the maintainability of the petition at this stage.

Justice Talukdar had stayed the election process for the three-tier panchayat elections on April 12 and had directed the SEC to submit a comprehensive report including filing of nomination and rejection of nomination.

SEC secretary Nilanjan Shandilya, who appeared in person before the court in view of an ongoing ceasework by lawyers, submitted the report today.
