Justice Karnan rejects bailable warrant issued against him by Supreme Court

A team of about 100 policemen visited the residence of Calcutta High Court Judge Justice CS Karnan on Friday to serve him the bailable warrant issued against him by the Supreme Court. 

Top cops including Director General of Police Surajit Kar Purkayastha, Commissioner of Kolkata Police Rajiv Kumar and ADG, CID Dr Rajesh Kumar led the team which visited Justice Karnan’s residence at New Town at about 11 am in the morning. The purpose of the visit was to give him the warrant and get his signature for the personal bond of Rs 10,000. 

Interestingly, while police sources said that he had accepted the warrant, Justice Karnan’s counsel W Peter Ramesh Kumar told DNA that he had refused the warrant. “He has not signed on any paper and will not appear at the court on March 31 as he had been. As a result, there will inevitably a non-bailable warrant will be issued against him and he has to be arrested in that case,” Kumar said. He said that there was no need for a huge contingent of police to come over for delivering the warrant. “He is a sitting judge and not some hardcore criminal. About 70 policemen were waiting outside the main gate while about 30 came over to see him to get the document signed. We will meet other friends and will put up a demonstration if he is arrested. It will be done after March 31 looking at the developments. The place and date will be decided later. It will be either at the Jantar Mantar, the Raj Bhavan or the Governor House,” he added.

Later, Justice Karnan wrote a letter to the seven judges of the Supreme Court including the Chief Justice of India saying that top police officials from the Calcutta High Court Circle came to his residence to execute the warrant and that he had rejected it after assigning valid reasons. The letter further said that it brought a lot of embarrassment to ‘a dalit judge’.

Talking to DNA, Dr Kumar said, “We have served the copy of the warrant and all the formalities have been properly done and now we will submit it to the Supreme Court.”
