We can't fire on public: Maharashtra government on dahi handi violations

The state government was on the defensive on Friday over the innumerable violations of the Supreme Court order during the dahi handi celebrations held across the state on Thursday. While top officials termed the government's response "practical, and the best possible one given the circumstances", the petitioner, who had taken the case all the way to the SC, told dna that she was going to put up a fight over these violations. She termed the violations an "outright contempt of court".

Defending the state government, KP Bakshi, additional chief secretary (Home) said, "Out of 3,500 mandals in the state, only 21 cases have been registered, which makes it less than one percent of cases. We cannot fire on the public or lathicharge or put barricades. Hence, we have taken a practical way of registering the cases. Chargesheets will be filed against them."

According to Mumbai police spokesperson, deputy commissioner Ashok Dudhe, "21 cases have been registered against mandals and organisers. The cases are registered under sections 188 (disobedience to order duly promulgated by public servant) and 336 (endangering life or personal safety of others) of the Indian Penal Code."

While commissioner of police Datta Padsalgikar, Joint. Commissioner of Police. ( Law & Order ) Deven Bharti remained unavailable for comments, to dna query if the violations could have been averted if the police acted upon earlier itself, Dudhe said, "Police have done everything to maintain the situation under control. The cases registered are a proof of the same. Now, action will follow."

Swati Patil, the petitioner, said, "I am very upset with police inaction. This is outright contempt of court. I am going to write an RTI to the Maharashtra police to get information about the violations. Also, I will approach the SC again and make sure next year such violations don't happen."
