Was Nagaland rape a case of consensual sex?

The Nagaland rape and lynching case is getting murkier and it seems now that till now floating story of rape that eventually resulted in accused Syed Sarif Khan getting lynched by the mob could be incorrect. The report of the incident submitted to the Union home ministry on Wednesday by the chief secretary of Nagaland government mentioned the statement of Khan wherein he said that it was consensual sex and not rape.

The Nagaland rape and lynching case is getting murkier and it seems now that till now floating story of rape that eventually resulted in accused Syed Sarif Khan getting lynched by the mob could be incorrect. The report of the incident submitted to the Union home ministry on Wednesday by the chief secretary of Nagaland government mentioned the statement of Khan wherein he said that it was consensual sex and not rape.

In a statement given to police after his arrest on February 24 , Khan had said that he paid Rs 5,000 to the alleged rape victim after they had sex not once but twice at different locations. Khan had also told police that the girl went with him on her free will and had demanded Rs. 2 lakh to keep her mouth shut after having consensual sex that he refused to pay.

The statement of the deceased Khan puts the three suspended government officials - deputy commissioner of Dimapur, Wezope Kenye, superintendent of police, Meren Jamir and senior superintendent of central jail, Chuba Phom - in the dock for doing precious little to stop the unruly mob on March 5 that entered a well guarded prison and got easy access to Khan's cell.

The unruly mob broke into the jail, dragged him out, stripped him naked, beat him up, pelted him with stones and then dragged him towards the centre of Dimapur town some 7 kilometres away. The mob did not stop there and displayed Khan's badly bruised body at the clock tower.

Nagaland chief minister TR Zeliang, however, said that at present nothing could be said conclusively, whether it was consensual sex or rape. "Investigation into the case is still going on and on the basis of medical examination and forensic evidence, the case would be taken forward," he said.

The medical examination of Khan and alleged rape victim had been conducted after the incident. Forensic evidences collected from the alleged rape victim and Khan have been sent to the Central Forensic Science Laboratory in Guwahati for obtaining expert opinion.

Police investigation was also made at Hotel De Oriental Dream (where accused Khan had alleged taken the victim) and CCTV footage were collected with necessary documents, said home ministry official quoting from the report.

An earlier report sent by the police had said that a local Naga youth was allegedly involved in helping Khan in the incident and he too was arrested and sent to Dimapur central jail along with Khan. However, the mob did not touch the Naga youth when Khan was dragged out of the prison on March 5 and lynched.
