Victim’s father, Bihar govt move SC against Shahabuddin’s bail

Facing criticism over his release and RJD head Lalu Prasad Yadav’s silence over the issue, Bihar government has also filed the appeal in the apex court. With these pleas, three petitions have been filed before the top court.

More trouble for former RJD MP Mohammed Shahabuddin, who was released on bail by the Patna High Court in a murder case, as the victim’s father has knocked the door of Supreme Court challenging the September 10.

Facing criticism over his release and RJD head Lalu Prasad Yadav’s silence over the issue, Bihar government has also filed the appeal in the apex court. With these pleas, three petitions have been filed before the top court.

On Wednesday, widow of a slain journalist Rajdeo Ranjan has also moved the Supreme Court seeking a direction to register an FIR against the Siwan leader after suspecting him and his henchmen were behind the killing in May this year.

Chandrakeshwar Prasad, whose eldest son was killed at the instance of Shahbuddin as he was witness to the killing of his two brothers in 2004 and the former MP was the accused in that case, in his petition said that the high court order is totally unacceptable.

The high court has completely overlooked the fact that Shahabuddin was a dreaded criminal, who has absolutely no respect for the law. Granting bail to him in the present case would be grossly unfair as he is still facing trial in several other cases.

Prasad filed his plea through advocate Prashant Bhushan who has mentioned before the court of Chief Justice of India (CJI) TS Thakur for early hearing of the case. The court agreed to hear the plea on Monday. Even the Bihar government’s plea is also likely to come up for hearing on the same day.

Both the petition have cited that Shahabuddin was booked in at least 58 criminal cases and he has been convicted in at least eight of them. Being a two-time MLA and a four-time MP from Siwan makes Shahabuddin a very influential person and this may impact the trial.

Shahabuddin has been debarred from contesting elections since 2009. The charges he is facing include murder, attempt to murder, kidnapping or abducting with intent to murder, extortion, theft, rioting with deadly weapons and treason.

Prasad has contended that the high court has completely overlooked the crucial facts that Shahabuddin in the present case, is facing the charge of getting an eye-witness to a twin murder, committed by him only, killed and also that he has ultimately been convicted in the said twin murder case. 

“In the last 11 years, Shahabuddin was at least twice transferred out of Siwan jail, for few months each time, to the Bhagalpur and Gaya jails as it was widely reported in media that he was abusing his clouts in jail by getting all sorts of illegal facilities like holding meeting inside the jail, using mobile phones from inside the jail to threaten or for asking ransom etc....,” as per the plea.
