UP: Husband throws out wife suspecting she conceived his father's son after Nikah Halala

 In yet another shocking case of Nikah-Halala in Bareilly district of Uttar Pradesh, a husband has thrown his wife out of the house when she gave birth to a male child after remarriage suspecting that the son belonged to his father. The man's father performed Nikah-Halala with the lady after instant triple talaq.

A resident of Bareilly, the victim was married to a transporter in Sambhal on September 2015. But soon after her marriage, she was harassed for not bringing adequate dowry. On December 24 2015, she was thrown out of her husband’s house by in-laws.    

Three days later, her husband pronounced instant triple talaq over phone. Efforts to reach a compromise dragged on for a year. Her husband finally agreed to remarry her when elders intervened but on a condition that she will have to go Nikah-Halala with his father.

“I was under tremendous pressure from my parents and relatives and was left with no choice than to agree for Nikah-Halala with my father-in-law. Nikah with my husband’s father was solemnized on December 24 2016", says the victim. Victim indicated that she was taken advantage of, before being given triple talaq the next day. 

As per Islamic laws, she was asked to complete ‘Iddat’ period of three months and ten days before remarriage with her first husband. “During the Iddat period, my first husband forcefully made sexual relations despite my protest. I got pregnant. After the Iddat period was over, my husband married me again on April 5 2017,” said she.

But when her husband came to know about her pregnancy, he forced her for abortion suspecting that the child belonged to his father. “When I refused to go for the abortion, he thrashed me and held me in captivity without giving any food for days. Somehow, I managed to send a complaint to the Nakhas Police Station which rescued me from his captivity,” claimed she.

“The police sent me to my parents’ place and had detained my husband. He was released only after he assured to accept me as his wife and take me back to his home. In the meantime, I gave birth to a son but my husband never returned to take me and his son back till date,” said she.

“I am ready for a DNA test to prove that my 10-month-old son was fathered by my husband. I am ready for any punishment if the DNA report proves me wrong,” she dared. Farhat Nqavi, sister of Union Minister Mukhtar Abbas Naqvi and Chairperson Mera Haq Foundation, which has taken up her case, said that her NGO will file an application into the ongoing Nikha-Halala case in Supreme Court and will also approach the National and State Women Commission to seek justice for the victim of Nikah-Halala.

The NGO is also likely to file an FIR against the husband and his father on charges of rape as the Nikah-Halala by father-in-law and sexual relations (by first husband or anyone) during the period of Iddat is against the provisions of Sharia.
