Unnao rape case: Allahabad HC stays POCSO Court hearing, seeks reply from CBI

The Allahabad High Court on Monday stayed hearing at the POCSO Court Unnao in gangrape and murder case against the BJP MLA Kuldeep Singh Sengar after the victim’s mother filed an application charging the agency of playing partisan role and carrying shoddy investigation on charges under the POCSO Act against accused.

The two-member bench comprising Justice DB Bhosale and Justice Suneet Kumar has sought reply from the CBI on allegations leveled by the victim’s mother. The bench stayed hearing in the POCSO Court Unnao till further orders. The court has fixed May 30 as the next date of hearing.

When the hearing resumed on Monday, the CBI submitted its second status report before the court with the details of the progress it had made in the case against the BJP MLA and his associates facing charges of gangrape and murder of victim’s father.

While the arguments were on, victim’s mother submitted an application before the bench alleging that the CBI was playing a partisan role in its investigation over charged against the accused under POCSO ACT to save them. Though the CBI denied the charge but the two-member bench stayed hearing at the POCSO Court Unnao till further orders and directed the agency to file a written reply fixing May 30 as the next date of the hearing.

In its status report, the CBI gave details about evidences it collected to charge the BJP MLA with hatching a conspiracy along with police officials of Makhi Police Station to send victim’s father to jail on April 3. They allegedly showed recovery of a country-made pistol from his possession to send him in the jail after Sengar’s brother and his henchmen assaulted victim’s father.

The CBI has already arrested then SHO and a Sub-Inspector of Makhi Police Station who admitted the conspiracy theory. The CBI claimed that it has clinching evidences to prove Sengar’s hand in the arrest of victim’s father on fake charges. He was also denied proper medical care on the directions of the BJP MLA after the brutal assault. Subsequently, he succumbed to internal injuries on April 9 in police custody.
