Unnao case: Murder charges slapped on brother of BJP MLA Kuldeep Singh, booked under Section 302

A joint team of the Crime Branch Lucknow and the Unnao Police arrested Atul Singh, brother of the rape accused BJP MLA Kuldeep Singh Sengar, from Kanpur on Tuesday. Later police booked him under Section 302 (murder). All the five accused, who have been charged under Section 302 now, were sent to 14- day judicial custody by the court on Tuesday.

Atul Singh alias Jaideep Singh Sengar was wanted in connection with a brutal assault on rape victim’s father Surendra Singh, who succumbed to injuries on Monday morning in police custody. 

The DGP O.P. Singh said that the arrest was made after the investigating team found clinching evidence against Atul Singh’s involvement in the assault on rape victim’s father which led to his death. Four associates of the BJP MLA, who were accused in the assault on Surendra Singh, were already arrested on Monday by the Unnao Police.

The DGP has constituted a Special Investigation (SIT) team to probe rape and murder charges against the BJP MLA from Bangermau in Unnao Kuldeep Singh Sengar, his brother, and other accomplices. The Yogi Adityanath government has already instituted a magisterial inquiry on Monday. 

The Post-mortem report of the deceased suggests that the victim died due to shock and septicemia following excessive internal hemorrhage and fatal injuries in the intestine. His body bore 16 injury marks confirming brutal assault and torture by MLA’s brother and four others.

Deceased wife Asha had lodged a hand-written complaint on April 3 against Atul Singh alias Jaideep Singh and others but MLA's brother was dropped from the Final FIR registered on April 4. But after autopsy report and DGP’s directions, the investigating team have been directed to include Atul Singh’s name also in the FIR and slap Section 302 of the IPC against him and other accused.

The rape victim had alleged that her father was dragged from home by Atul Singh and four others on April 3 on gun-point. She charged that her husband was tied from a tree and then brutally assaulted with sticks and iron rods till he fell unconscious by the MLA’s brother and four others.

“They were pressurizing my husband to withdraw the court case under Section 156/3 against the BJP MLA, his brother, and others. When my husband refused, they assaulted him brutally,” said Asha.

She alleged that instead of arresting MLA’s brother and others, Makhi Police lodged a fake case against her injured husband and put him in jail where he was denied any medical help despite our repeated request. When his condition deteriorated on Sunday, he was rushed to Unnao District Hospital where he succumbed to injuries on Monday, she charged.

A video also got viral on Tuesday showing policemen and BJP MLA’s henchmen forcing the critically injured deceased to give thumb impression on a piece of paper instead of taking him to the hospital for treatment.

Asha claimed that she had met the District Magistrate and the SP also but they did not offer any help. Later, the rape victim, her mother Asha had made an abortive suicide bid outside CM’s Residence on March 9.

The investigating team has no answers to why the name of Atul Singh was dropped from the FIR and why was he arrested then on Tuesday when his name didn’t figure in the FIR?  

“We demand a CBI probe and immediate arrest of Kuldeep Singh Sengar who raped my daughter and killed my husband,” demanded Asha. “He should be hanged for my rape and murder of my father,” fumed the rape victim.

The deceased daughter was allegedly raped by the BJP MLA and his brother for eight days in June 2017 when she went to him seeking a job. The BJP MLA has, however, denied the rape charge saying that he was being falsely implicated in the case.  

Kuldeep Singh Sengar and his brother Atul Sigh have many cases pending against him in different police stations in Unnao district. He and his brother are accused of opening fire at then ASP Ram Lal Verma when he had gone to investigate a case pertaining to the attack on a local journalist. The ASP was shot into the stomach.

Both were also accused in case of a threat to a TV journalist who had exposed his illegal mining business. They are known as tender and illegal mining mafia in Unnao. Four-time MLA, Kuldeep Singh Sengar had started his political career with Congress and switched loyalty to BSP and Samajwadi Party before joining the BJP in 2017 and winning again.
