Additional Sessions Judge Kaveri Baweja recorded the testimonies of sub inspector Devender, who had arrested 32- year-old Shiv Kumar Yadav from Mathura, and sub inspector Sandeep who had seized the driver's Swift Dzire in which the alleged incident took place on the night of December 5, 2014. SI Devender, deposing as a prosecution witness, said on December 7, 2014, a team was constituted and he along with other cops had gone to Mathura to arrest the accused.
A secret information was received that Yadav was hiding near a marriage hall in Mathura where raid was conducted and the accused was arrested, he said. SI Sandeep testified that on December 6, 2014, he was deputed to search for the vehicle involved in the crime and he got to know about the Delhi address of the car's owner but he was not found there. When he reached Yadav's permanent address in Mathura, he found the car parked there but the driver was not available. He took the vehicle in his possession, the official said.
The recording of statements of both the cops remained inconclusive and would continue on Friday.
Apart from these two police officials, the court has summoned eight more prosecution witnesses on Friday as part of daily hearings in the case. The court had earlier recorded statements of 12 witnesses including the victim who had identified Yadav as the one who had raped her on the night of December 5, 2014 when she had hired the cab and was returning home in west Delhi's Inderlok.
The court has recorded the testimony of the doctor who had examined the woman after the incident and had confirmed that the victim was sexually assaulted. The woman executive, who had stood firm on her stand during her examination, had deposed that the accused had forced upon her.
The court has framed charges against Yadav under various sections of the Indian Penal Code for alleged offences of endangering a woman's life while raping her, kidnapping her with an intent to compel her for marriage, criminally intimidating and causing hurt.
