Special CBI Judge L K Gaur awarded the jail term to Haryana's Jhajjar resident Ram Kumar and Jind's resident Ram Kumar. The two were suspended in 2004 in connection with the inquiry ordered into a video tapes showing policemen taking bribe from bootleggers.
"There is no manner of doubt that the accused persons had no business to take money from Bina Sansi (bootlegger), it is abundantly clear that they had abused their position as officials of Delhi Police thus, they can be said to have committed the offence under the provisions of Prevention of Corruption (PC) Act, 1988," the court said.
It also imposed a fine of Rs 40,000 and Rs 60,000 on Ram Kumar (Jhajjar resident) and Ram Kumar (Jind resident).
They were held guilty for the offences of public servant taking illegal gratification in respect of an official act and committing criminal misconduct under the PC Act and criminal conspiracy under the IPC.
A case was registered by the CBI on the complaint of one Chetan Prakash who had videographed several cops of Delhi Police and Excise Department of Delhi Government taking money from bootleggers in Uttam Nagar area.
One of the cassettes showed video clippings of scenes he had shot at the residences of various bootleggers including one Jasbir Sansi and his wife Beena Sansi at DDA Flats, Bindapur during 200203, the CBI's charge sheet said.
In the clipping, one of the accused HC Ram Kumar was seen sitting in a chair in front of the house of Beena Sansi who was seen selling liquor bottles and the other cop Ram Kumar could be seen accepting currency notes from Beena and keeping it in his pocket.
When Beena handed over Rs 100 to the two cops, they asked her to give Rs 100 more as they were two men, the charge sheet said.
The court, while holding the two guilty, said once the conclusion is reached that there was a demand for money from the side of the accused and the money was accepted, it can be presumed under provision of PC Act that they had received this money as a motive or reward for forbearing to do any official act.
"In my view, the above facts are good enough to establish the conspiracy between the two accused persons and it is also clear that the conspiracy was to demand money for forbearing to take action against Beena Sansi i.e. to commit offence under provisions of the PC Act," the judge said.
